A substantial amount of Mr. Tucker’s practice is devoted to residential and commercial landlord-tenant law. Mr. Tucker has a comprehensive understanding of the laws and regulations relating to landlord tenant law in New Mexico, and provides services to both landlords/owners as well as to business tenants.
In the area of residential landlord tenant law, Mr. Tucker represent a wide range of clients from mom-and-pop individual property owners to large national apartment owners and property management companies. Services include but are not limited to drafting and reviewing lease agreements and other contracts, negotiation of utility and service contracts, drafting demand letters and/or default notices, filing lawsuits to either evict tenants, to force compliance with contractual obligations, collection actions, defense of New Mexico Human Rights and/or Federal Fair Housing discrimination claims, reasonable accommodation requests by handicapped and/or disabled tenants and medical marijuana and assistive animal issues.
In area of commercial landlord tenant law, Mr. Tucker represents commercial tenants and local and national property management companies as well as owners of commercial real estate and rental space. Services include but are not limited to drafting and reviewing lease contracts, sending default notices and/or demand letters, litigation related to collections, property damage and/or defense of personal injury claims related to premises liability.
Mr. Tucker has taught classes on Fair Housing discrimination and other aspects of residential and commercial landlord tenant law and application and collection procedures. Mr. Tucker has been an affiliate member in the Apartment Association of New Mexico, and has represented the Apartment Association of New Mexico as well as the National Apartment Association. We also have clients in a number of associated businesses in the areas of tenant screening, tenant locator services and landscaping maintenance.
